(Terms of Use)
1. PREAMBLE
Welcome to Braiins Hashpower!
Braiins Hashpower lets you access hash rate (computing power) for cryptocurrency mining without needing to own, host, or manage physical mining hardware. Instead, you can purchase a hash rate through our platform and decide when and where it is delivered, using one of our supported mining pools or solo mining methods.
These Terms of Use explain how Braiins Hashpower works, including: how hash rate is purchased, how and when delivery is requested, and what you can expect from the service.
We've written these Terms to be as clear and straightforward as possible. While they are a legal agreement, our goal is to explain the essential mechanics of the service in plain language—without unnecessary legal jargon.
By using Braiins Hashpower, you agree to these Terms. If something doesn't make sense, we encourage you to reach out before using the service.
Additionally, you agree to use Braiins Hashpower in compliance with all applicable laws, regulations, and legal obligations in any jurisdiction relevant to your use of the service.
You are solely responsible for determining whether your purchase of hash rate, participation in mining activities, and receipt of mining rewards are lawful in your jurisdiction and for complying with any applicable reporting, tax, or regulatory requirements.
2. PARTIES
Can you introduce yourselves...
We are a commercial company called Braiins Mining Limited, incorporated and existing under the laws of the British Virgin Islands, Company No. 2038702, with a registered office at Road Town, Tortola, British Virgin Islands.
I guess, now a little bit about me...
When we refer to "you" or "your" in these Terms, we mean any individual or legal entity that: creates a Braiins Hashpower user account, and/or purchases hash rate through that account.
It probably goes without saying, but your legal capacity must not be limited to the extent that could in any way prevent you from purchasing hash rate via Braiins Hashpower or from effectively agreeing to and complying with these Terms.
If you plan to use Braiins Hashpower on behalf of any other person, whether individual or legal person, you must have legal authority to do so.
I am a returning user...
If you have used Braiins Hashpower before and now plan on coming back, that is great news and we welcome you with open arms, unless your previous access to Braiins Hashpower has been terminated by us for a breach of rules including these Terms.
If your previous access has been in fact terminated for a breach of rules, we reserve the right not to open any new user accounts for you and to terminate any existing user accounts that you may have been able to create in the meantime.
3. USER ACCOUNT
How do I get started?
Getting started with Braiins Hashpower is simple. To use the service, you must first create a user account.
Account registration requires your Telegram user account, and your email address. We require two independent contact methods so you always have reliable ways to receive important service communications and, where possible, recover access to your account.
Once your account is successfully created and activated a dedicated payment address will be generated for you, and you will gain access to available hash rate offers and delivery options.
Your responsibility for the user account
Your user account is personal to you. You are solely responsible for: keeping your account access information secure, maintaining access to your registered Telegram account and email address, securely storing and protecting your access tokens, and all activity that occurs on or through your user account.
If you lose access to your account or recovery channels, we may not be able to restore access or reverse completed actions. You must notify us immediately if you suspect any unauthorized access to your user account.
Access tokens – very important
When you create a user account, you are issued two unique access tokens: Owner Token, which allows you to perform actions such as log in, purchasing hash rate and managing delivery; and a Read-only Token, which allows you to view account information without making changes.
These tokens are generated specifically for your account and are displayed only once, at the time of account creation. The tokens are required to access and operate your account. If you lose them, we may not be able to restore access.
Any actions performed using a valid token are treated as authorized by you. You are solely responsible for: securely storing both tokens, keeping them confidential, and preventing unauthorized access or use.
We do not store access tokens in a recoverable form and cannot re-display them after initial issuance. Loss, disclosure, or compromise of a token may result in loss of access to your account, unauthorized actions, or loss of purchased hash rate.
To the maximum extent permitted by law, we are not responsible for any loss, damage, or consequences resulting from lost, exposed, or misused tokens. If you believe that a token has been compromised, you must notify us immediately so that we can take reasonable steps to limit further damage, where possible.
Accuracy of information
When providing information to us in connection with your user account or use of the service, you agree that all information must be true, accurate, and complete. We do not support the misuse of third-party information. Providing false, misleading, or unauthorized information may result in suspension or termination of your user account.
4. HASH RATE
What is the hash rate?
In cryptocurrency mining, "hash rate" refers to the speed at which a mining device performs the mathematical computations required to validate transactions and add blocks to the blockchain. The higher the hash rate, the more computations the device can execute per second.
Hash rate is usually expressed in: hashes per second (H/s), kilohashes (kH/s), megahashes (MH/s), gigahashes (GH/s), or terahashes (TH/s), depending on the scale.
Can hash rate be purchased or sold?
Hash rate is a unit of measurement and cannot be bought or sold directly. When we refer to "purchasing hash rate," we mean leasing the amount of computing power corresponding to a specified hash rate from mining equipment for a defined period. Effectively, purchasing hash rate is the same as leasing mining hardware capacity for that duration.
5. HASH RATE SALE AND DELIVERY
Who is the seller?
For every purchase made through Braiins Hashpower, we are always the seller of the hash rate. This is true whether the computing power used for delivery comes from: our own mining hardware, or a third-party provider that supplies hash rate to us. Your contract is always directly with us. We are fully responsible for delivering the amount of hash rate you purchase in accordance with these Terms.
When is the hash rate considered delivered?
The delivery process works as follows:
- You purchase a hash rate by sending your selected amount of BTC to your dedicated Bitcoin address, which is displayed in your user account interface.
- You request delivery by either: submitting a delivery request with your chosen hash rate amount and pool or solo mining parameters and any other delivery-related settings available on the platform, or selecting an instant delivery option with predefined, immediately available parameters.
- If sufficient matching hash rate is available, delivery begins automatically. If matching hash rate is not available for a custom delivery request, the request remains pending until fulfilled, modified, or cancelled. For instant delivery options, availability is confirmed in advance, the delivery parameters are set by us, and delivery begins without waiting for additional supply.
Delivery means that the corresponding amount of computing power is actively used for cryptocurrency mining on the supported mining pool or via the solo mining method you selected.
During delivery, the actual computing power may fluctuate. This is a normal aspect of cryptocurrency mining and does not constitute a breach of contract. Regardless of short-term fluctuations, the total hash rate delivered over the full delivery period will always be equal to or greater than the amount you purchased (calculated as purchased hash rate x delivery duration).
If, for any reason, the total delivered amount temporarily falls below the purchased amount, the delivery period may be automatically extended to allow full delivery. The hash rate purchase contract is considered fully performed once the entire purchased amount has been delivered.
All mining rewards generated during delivery are credited directly to your account at the selected mining pool or your BTC address (in case of solo mining). You are responsible for reviewing and understanding the terms, fees, and payout mechanics of the selected mining pool. You confirm that: the mining pool account you specify belongs to you, and you are the lawful recipient of all mining rewards paid to that account.
6. PRICE AND PAYMENT
Let's talk about money...
When you send a payment to the dedicated payment address shown in your Braiins Hashpower account, you enter into a binding contract to purchase hash rate from us. The purchase is priced and paid entirely in Bitcoin (BTC), and the purchase price is fixed at the time of payment. By completing the payment, you have fully paid for the hash rate. The purchase is complete at that moment, even though the exact amount of hash rate to be delivered is determined later.
You are purchasing a hash rate itself—not a wallet balance, credit, or prepaid funds.
How is the amount of hash rate determined?
The amount of hash rate delivered to you is determined after you complete your purchase, based on how you request delivery. After purchasing hash rate, you decide how it is delivered by either: submitting a delivery request that specifies the amount of hash rate you wish to receive and the mining pool or solo mining parameters, or selecting an instant delivery option with predefined, immediately available parameters.
In simple terms: you purchase hash rate first, you request delivery afterward, and the delivery request you choose determines how much hash rate is delivered and when delivery takes place.
Means of payment
All prices are quoted and all payments are made exclusively in Bitcoin (BTC). If a fiat currency equivalent must be calculated for tax, accounting, or reporting purposes, both parties will use the Bitcoin exchange rate published by CoinMarketCap under the applicable "Close" price for the relevant date.
A Bitcoin payment is considered completed when: it is sent to the Bitcoin address shown in your account, and the transaction has received at least three (3) confirmations on the Bitcoin network.
Are transaction fees included?
No. Any Bitcoin network transaction fees or other costs related to making the payment are your responsibility and must be paid in addition to the purchase price.
Taxes, duties, and other charges
You are responsible for any taxes, duties, or governmental fees related to your purchase of hash rate. We must always receive the full agreed purchase price, without reduction for any taxes or fees you may owe to third parties.
What if the purchase price is not paid correctly?
The hash rate purchase contract becomes effective only once the full Bitcoin payment has been successfully received and confirmed. Until that time: no hash rate is considered purchased, and we have no obligation to deliver a hash rate. Payments that are incomplete, sent to an incorrect address, or that do not receive the required network confirmations do not result in a valid purchase.
Ownership confirmation
By submitting a purchase request, you confirm that: you are the lawful owner of the Bitcoin used to make the payment, and you are the rightful owner of the mining pool account designated for hash rate delivery.
7. KYC REQUIREMENTS
Do I need to complete KYC?
Although we may not be legally required to conduct Know Your Customer (KYC) checks in all jurisdictions, we may apply KYC and related verification measures as part of our internal risk-management and compliance policies. These measures help prevent misuse of the service and support a safe, transparent, and compliant operating environment.
Whether KYC is required for your use of the service is determined at our discretion, based on our internal policies as updated from time to time and communicated through the platform.
When is KYC required?
KYC may be required, among other things, based on: the size or value of a purchase or series of related purchases, transaction patterns or frequency, the type of user (individual or business), risk indicators, compliance considerations, or operational factors. Any applicable thresholds, limits, or criteria are determined by us from time to time and made available through the website or user interface. We may modify these criteria without updating these Terms, provided the current requirements are communicated on the platform.
How is the threshold calculated?
Since all payments are made in Bitcoin (BTC), the USD equivalent for the purposes of calculating any thresholds will be calculated using the CoinMarketCap "Close" price on the date you submit the purchase request.
For the purpose of determining whether the threshold has been reached, we may treat multiple separate or related purchase requests placed by you within a reasonable period (typically 30 days, unless circumstances suggest otherwise) as connected transactions and evaluate them collectively.
What information or documents may be required?
Depending on the circumstances, we may request information or documentation including, but not limited to: identification of you as an individual or of your company (such as name, registration number, and registered office); identification of authorized representatives or controllers; basic ownership or control information; confirmation or explanation of the source of funds; additional documentation or information where enhanced verification is warranted. We request only information we reasonably consider necessary and proportionate in light of the applicable risk and compliance requirements.
Accuracy and ongoing updates
You represent and warrant that all information provided in connection with KYC or verification is accurate, complete, and up to date. You agree to promptly notify us of any relevant changes, including changes to ownership, control, authorized representatives, or other material information. We may request updated or additional information periodically to maintain compliance with our internal policies.
Enhanced KYC
Even if you would not otherwise be required to complete KYC under the criteria published on the website, we may apply enhanced KYC measures if, in our judgment: your activity raises fraud, compliance, or AML concerns; transaction patterns appear unusual or inconsistent; additional verification is necessary to protect the integrity of the service. Enhanced KYC may include additional documentation, explanations, or verification steps.
What happens if I do not complete the required KYC?
If you fail to provide required KYC information, provide inaccurate or incomplete information, or if we are unable to verify the information provided, we may, at our sole discretion: suspend or decline review or processing of a purchase request; suspend or terminate your user account; freeze any cryptocurrency, hash rate delivery, or other value associated with your account.
A freeze means that: you cannot request or receive hash rate delivery; you cannot use funds to make purchases; you cannot receive a refund, including upon termination. The freeze remains in effect until verification is successfully completed and release is legally permitted.
If verification is not completed within a reasonable period, we may reject or terminate the relevant contract while maintaining the freeze until compliance requirements are satisfied.
Funds frozen for more than one (1) year
If funds remain frozen for more than one (1) year due to your failure to complete KYC verification or provide information required to legally release the funds: you will be deemed to have abandoned any claim to those funds; and the funds will be treated as a voluntary, irrevocable contribution supporting the development and operation of the project. This mechanism exists to prevent the indefinite holding of funds that cannot be lawfully released and reflects your contractual obligation to cooperate with identity and compliance verification. We will make reasonable efforts to notify you at least once before the one-year period expires, using the contact details associated with your user account.
Refusal of business
We may refuse to enter into a contract with you or decline any purchase request at our sole discretion, including for risk, compliance, operational, or business reasons, regardless of whether KYC has been completed.
8. USER ACCOUNT SUSPENSIONS
Our right to suspend or terminate your account
We are entitled to suspend or terminate your user account and/or any active hash rate purchase contracts if, in our reasonable judgment: you violate these Terms or any applicable laws or regulations; you attempt to circumvent system limits, improperly automate requests, manipulate pricing, or interfere with hash rate delivery; you provide false, incomplete, misleading, or outdated identification or KYC information; you fail to complete required KYC or verification procedures within the requested timeframe; your activity raises compliance, fraud, sanctions, or anti-money-laundering (AML) concerns; you become subject to insolvency, enforcement actions, asset freezes, liquidation, or similar proceedings; continued provision of the service becomes commercially unreasonable, technically infeasible, or legally prohibited. Where the risk warrants it, suspension may take effect immediately and without prior notice.
9. SANCTIONS COMPLIANCE
Do you comply with international sanctions programs?
As mentioned before, we are based in the British Virgin Islands and are subject to its local laws and regulations. However, even though we do not fall within the jurisdiction of OFAC (Office of Foreign Assets Control of the United States of America), we have chosen not to do any business with anybody who falls within any OFAC sanctions programs.
What does it mean for me?
When you agree with these Terms, you also represent, that you are not subject to sanctions under any of the OFAC sanctions programs and are not listed on any of the sanctioned entities lists kept by the OFAC and you will ensure that this representation remains true as long as there is any business relationship between you and us (as long as your user account is open).
What if I am subject to sanctions?
If we learn (or have a reasonable cause to suspect) that you are subject to the sanctions under any of the OFAC sanctions programs (for example, if some of your information are listed on OFAC moderated list of sanctioned entities), it is considered as gross breach of the contract, and we have a right to immediately and for indefinite term suspend your user account. We may choose to suspend only some functionalities of the user account at our sole discretion.
What if my user account was suspended by mistake?
If your user account is suspended, you are then entitled to initiate review by contacting us. The review may include a thorough KYC check carried out by our support team etc. and it is at our sole discretion to decide whether sufficient evidence was provided to revoke the suspension. We will always notify you about the outcome of the review.
What if I am in fact subject to sanctions?
If, within one (1) year after we notify you of the suspension of your user account, you either do not initiate a review, or you initiate a review but fail to provide sufficient evidence demonstrating that you are not subject to OFAC sanctions, any frozen funds will be handled in the same manner as other freezes described in Section 7 of these Terms.
10. TERMINATION
Your right to withdraw before delivery begins
When you make a payment, the contract for the purchase of the hash rate is concluded immediately.
However, if you are acting as a consumer and applicable consumer-protection laws apply to you, you have the right to withdraw from the contract for a period of fourteen (14) days after the payment until the moment hash rate delivery actually begins (delivery start). You may withdraw: directly through your user account (where available), or by contacting us through our designated support channels.
If your withdrawal request is submitted before delivery starts: the contract will be cancelled, and we will refund the full purchase price. Refunds will be made to the same Bitcoin address from which the original payment was made, unless a different method is required for legal or compliance reasons.
Withdrawal under this section is not a withdrawal of a balance, credit, or deposited funds. It is a cancellation of a concluded contract before performance has begun. Once Delivery Start occurs, the right to withdraw expires. After delivery begins, no refunds will be provided, except where mandatory law requires otherwise.
Termination of your user account
You may terminate your user account at any time, either: through the account interface (if such functionality is available), or by notifying us through our designated communication channels.
We are entitled to suspend or terminate your user account at any time and for any reason, with or without prior notice, including for operational, security, legal, compliance, or business reasons.
Account termination initiated by you does automatically cancel any active or completed hash rate purchase contracts to the extent the hash rate delivery has not yet started (for the hash rate delivery already started, the hash rate delivery will be fully performed).

Unsettled hash rate purchases after termination
If your user account is terminated while you have an unsettled hash rate purchase (meaning the purchase contract was concluded but hash rate delivery has not yet begun), we will generally treat you fairly and preserve your economic position as described below.
Ordinary case – refund
Unless your account was terminated due to a material breach of these Terms, fraud, misuse of the service, or similar misconduct, an unsettled hash rate purchase will ordinarily be refunded. In such a case, we will request that you provide a valid Bitcoin address so we can return the applicable amount. Refunds will be made to the same address used for payment, unless otherwise required for legal or compliance reasons.
Compliance holds (KYC, Source of Funds, Sanctions)
If a refund cannot be processed because: required KYC or verification has not been completed, source-of-funds checks are pending or unresolved, sanctions, AML, or similar compliance reviews apply, the refund amount will be temporarily withheld and not released until the relevant compliance requirements are satisfied or the restriction is lifted. Such withholding does not constitute a breach of contract and may continue for as long as required by law or our compliance obligations.
Failure to provide refund details
If we notify you to provide a refund address and you fail to do so within thirty (30) days after such notification, you will be deemed to have waived your claim to the refund amount, unless mandatory law requires otherwise.
Set-Off Rights
We may, at any time, set off any amount otherwise refundable to you against any claims we have against you, including claims arising from: breach of these Terms, misuse of the service, damages, costs, or losses incurred by us, unpaid fees or other amounts owed.
11. AVAILABILITY
You are always up, right?
We always attempt to provide continuous uninterrupted operation of Braiins Hashpower platform, so you can access it and mine the cryptocurrencies at any time.
However, due to maintenance, repairs or exceptional outages there may be occasions when Braiins Hashpower will not be available and therefore we cannot always guarantee a completely uninterrupted (100 %) availability.
If it is unavailable due to a planned temporary maintenance shutdown, we will attempt to inform you in advance. If, due to the nature of unavailability, we could not inform you in advance, we at least attempt to promptly resolve any issues and make it available again.
What if you decide to shut Braiins Hashpower down completely?
We work in a field of new technologies and you never know what will happen a month, year or ten years from now. Therefore, we cannot rule out that we will at some point discontinue Braiins Hashpower completely.
In that event, we will give you at least thirty (30) days prior notice. After the end of this notice period our relationship will be terminated and you will not be able to purchase hash rate or request delivery of previously purchased hash rate with Braiins Hashpower and to access your user account anymore.
12. LIABILITY AND WARRANTY LIMITATION
So where are the legal disclaimers?
You have just found them, so let's get it over with.
Please, be aware that we do not give you ownership of any intellectual property rights in Braiins Hashpower or any other products or services associated therewith, unless we say so explicitly. You are solely entitled to access and use the Braiins Hashpower platform for purchase of hash rate.
We operate Braiins Hashpower using a reasonable level of skill and care and we hope that you will enjoy using it; however, be aware that the entire platform is still offered to you on "as is" and "where-available" basis and, therefore, we expressly disclaim any warranties, express or implied, relating thereto.
We shall not under any circumstances be held liable to you for any direct, indirect, special, consequential, punitive or any other damages and costs including, but not limited to, loss of profit, loss of revenue or loss of business opportunity arising out of or in connection with your access and use or inability to access and use Braiins Hashpower.
Under certain laws it may not be possible to disclaim our liability and warranties completely. For such cases you hereby waive to the fullest extent permissible under any such law any claims for damages that you may have against us in relation with your use of Braiins Hashpower or inability to access it.
If the warranties and liabilities disclaimers above are found void or invalid or otherwise unenforceable, you agree that our total liability for any claims arising out of these Terms or in relation thereto are limited to the amount of purchase price paid to us by you in the period of three (3) months immediately preceding the event that gave rise to your claim.

...No profit or performance guarantees
Purchasing hash rate involves substantial risk and does not guarantee any level of mining rewards, profitability, or return on investment. You should use only funds that you can afford to lose and that are genuinely risk capital. Mining results depend on many factors outside our control, including: network difficulty and total network hash rate, block rewards and transaction fees, mining pool performance, market conditions, protocol changes, and other network events. You may receive fewer rewards than expected, or no rewards at all. Past performance does not guarantee future results.
...Solo mining risks
Solo mining involves significant variance and risk. By using the solo mining option on the Braiins Hashpower platform, you acknowledge that block rewards are not guaranteed and that you may receive no rewards for extended periods of time, or at all. Mining outcomes are probabilistic, fees and costs apply regardless of results, and we do not guarantee profitability or block discovery.
...Market and network changes
Cryptocurrency networks and mining economics can change rapidly and unpredictably. Protocol upgrades, difficulty adjustments, halvings, forks, governance decisions, or other network events may materially affect mining outcomes and rewards. Such changes do not constitute a breach of contract and do not entitle you to refunds, compensation, or price adjustments.
...Delivery is not continuous or constant
Hash rate delivery reflects real-world mining conditions. While we ensure that the total amount of hash rate you purchased is delivered over time, instantaneous performance may fluctuate. Temporary interruptions, variability, reallocation of hash rate, or changes in delivery patterns are normal and expected and do not mean delivery has failed or that we are in breach of our obligations.
...Third-party dependencies
Hash rate delivery may rely on: third-party mining pools, third-party infrastructure or hosting providers, or third-party hash rate suppliers. We are not responsible for outages, errors, performance degradation, rule changes, or losses caused by third parties, including mining pools you select. You are responsible for understanding, accepting, and complying with the terms, payout rules, and operational requirements of any mining pool you use.
...Not a wallet or custodial service
Braiins Hashpower is not a cryptocurrency wallet, exchange, brokerage, or custodial service. We do not hold, safeguard, or control your cryptocurrency. All mining proceeds are credited directly to the mining pool account you specify, subject to that pool's payout policies and technical processes.
...Irreversible transactions and configuration
Cryptocurrency transactions are irreversible. You are responsible for providing accurate mining pool details, payout addresses, and configuration parameters. If mining rewards are sent to an incorrect address or account due to your error, they cannot be reversed or recovered.
...Regulatory and legal uncertainty
Cryptocurrency mining and hash rate markets may be subject to changing laws, regulations, enforcement actions, or regulatory interpretations in different jurisdictions. The service is not intended for use or distribution in any jurisdiction where it would be unlawful. You are solely responsible for: understanding your legal and regulatory position, determining whether purchasing or selling hash rate is permitted, and ensuring compliance with all applicable laws, regulations, and reporting obligations. Changes in law or regulatory interpretation may affect your ability to use the service, request delivery, or receive rewards and do not entitle you to refunds unless required by mandatory law.
...No financial, tax, or investment advice
All information, communications, publications, and materials provided by us—including these Terms—are for informational purposes only. Nothing on the platform constitutes financial, investment, legal, or tax advice, nor should it be interpreted as a solicitation or recommendation to purchase or sell hash rate. You are solely responsible for assessing whether purchasing hash rate is appropriate for your circumstances, including your experience, objectives, financial resources, and risk tolerance.
...Force majeure
We are not responsible for any failure or delay in performance resulting from events beyond our reasonable control, including acts of God, war, terrorism, governmental actions, natural disasters, labor disputes, widespread power or network outages, or unforeseen technical failures. Such events do not constitute a breach of contract. The parties agree to act in good faith to mitigate the effects of a force majeure event and to resume performance as soon as reasonably possible.
13. CONFIDENTIALITY
It all sounds so great, I will tell about Braiins Hashpower everybody I know...
Great, we appreciate it, but please be discrete.
Sometimes we share with you information that is not meant to be public. For that reason we must ask you to keep confidential (not to disclose to third parties) the details of our mutual legal relationship (such as pricing and payment details or details about any tailored services), as well as any other information that you have learnt from us and that was marked, accompanied, or supported by documents designated as "confidential" or equivalent, or that was identified so by us, or should be reasonably known to you to be confidential.
The duty of confidentiality expires three (3) years from the date of disclosure. The obligation to protect technical information about our current products and services and all information about possible unreleased products or services never expires.
This applies to everything I know about Braiins Hashpower?
Of course this does not apply to information which was already in your possession before you received it from us; is or becomes publicly available through no fault of yours; is rightfully received by you from a third party who has no duty of confidentiality; or is independently developed by you without a breach of the confidentiality obligations hereunder.
What about my staff?
You may disclose confidential information to your directors, officers, employees, as well as your contractors, advisors, and agents, so long as those individuals have a need to know in their work for you and are bound by obligations of confidentiality at least as restrictive as those imposed on you in these Terms. You are fully liable for any breach of this obligation by the aforementioned third parties.

You can contact us electronically via tools available on our website or via the email address [email protected]. Your message is considered as delivered when we confirm its delivery to you, which we always attempt to do promptly.
We will not bother you too much, but occasionally we may have to contact you. In that event we will use either the email address listed under your user account or by a notice available to you upon logging into your user account.
We will occasionally send you an email with commercial announcements; you may at any time, without having to give a reason, opt out of these communications.
15. APPLICABLE LAW
What laws do apply?
The laws of the British Virgin Islands, without regard to principles of conflict of laws, will govern these Terms and any dispute of any sort that might arise between you and us in connection herewith.
16. DISPUTE RESOLUTION
What if we argue?
We always operate in a customer-friendly manner. We try to solve any issues peacefully and ask you to do the same. Therefore, you agree to notify us of any disputes arising out of or in connection with these Terms and you agree that you will always attempt an out-of-court dispute resolution before you bring the dispute before the courts.
However, sometimes out-of-court dispute resolution is just not possible. In that event, any dispute relating in any way to these Terms shall be decided with final effect before the courts of the British Virgin Islands.
Should you violate or threaten to violate our intellectual property rights in any manner, we may seek an injunction or other appropriate relief in any court of our choice. You consent to exclusive jurisdiction and venue in such courts.
17. MISCELLANEOUS
...severability
If any provision of this contract is held by any court or other competent authority to be invalid or unenforceable in whole or in part, this contract shall continue to be valid as to its other provisions and the remainder of the affected provision, unless it can be concluded from the circumstances that, in the absence of the provision found to be null and void, the parties would not have concluded this contract.
The parties shall use all reasonable efforts to replace all provisions found to be null and void by provisions that are valid under the applicable law and come closest to their original intention.
...entire agreement
These Terms set out the entire agreement between you and us. Neither party has entered into this contract in reliance upon any representation, warranty or undertaking of the other party that is not expressly set out or referred to in this contract.
...no assignment
You may not assign or transfer any of your rights or obligations assumed under these Terms or in any other way related hereto without our prior written consent.
...operator change (contract assignment)
You agree to any future change of the Braiins Hashpower platform operator (assignment of the contract). In case of such change we will always notify you.
...no waiver
If you do not comply with these Terms, and we do not take action right away, this doesn't mean that we are waiving any rights that we may have (such as taking action in the future).
...survival
All the provisions of these Terms that by their nature extend beyond the termination of mutual legal relationship, including but not limited to dispute resolution and applicable law clauses, shall survive the termination of our mutual legal relationship.
...languages
These Terms and all the related documents may be translated into multiple language versions. In case of any discrepancies between the individual language versions the English language version shall always control.
I did not like (something) I have read above.
We always attempt to make legal documents as brief and user friendly as possible, but we cannot completely make do without them.
So even though we regret it, if you do not agree with any part of these Terms or if you have any reservations, you may not mine with Braiins Hashpower and we must ask you to leave our platform immediately (but please, delete the user account first).
I found out there is a conflict between this document and the terms I found elsewhere.
If there is such a conflict, please let us know immediately, so that we can attend to it and improve our documentation. Meanwhile, these Terms will control for that conflict.
So, is that it? May I go ahead and start using Braiins Hashpower?
Just one last thing; we may change or amend these Terms or additional terms that apply to Braiins Hashpower from time to time, and if we do so, we will have to ask you to read through them and agree to them again.
We realize it's inconvenient for you, so we promise not to do it too often.
